TERMS AND CONDITIONS

 

You are agreeing to these terms and conditions when purchasing the gift card. If the gift card is purchased for use by a third party, the third party will be deemed to have accepted these terms and conditions upon first use of the gift card.

 

1.      Who is who in these conditions?

 

Firstly, there is you. From now on, we may also refer to you as the holder of the gift card. If you purchase the gift card for use by someone other than yourself, that person will be deemed to be the holder of the gift card and these terms and conditions will apply to them, as if they were you, from and including the first use of the gift card.

 

Secondly, there is us, Barceló Hotel Group. We issue the gift card and are the party selling this product. Legally, in these conditions we are the company Barceló Gestión Hotelera, S.L., with NIF B-07918287, and our registered office is at calle José Rover Motta, number 27, Palma de Mallorca.

 

2.      What are these terms and conditions?

 

These terms and conditions are the contractual document between you and us. They set out all the rights and obligations that both you and we will have as a result of the gift card.

 

3.      What is the gift card?

 

The gift card that you are acquiring is an instrument that provides the holder with a balance that can be used to purchase certain services in our different establishments, as detailed in these terms and conditions. The amount of the balance initially available to you will be equivalent to the purchase price of the gift card.

 

Despite the name, the gift card is not a physical card, but an electronic card. Upon purchase of the gift card, the holder of the card will receive a code by email, which will constitute the product, i.e. the gift card.

 

4.      Who can use the gift card?

 

The gift card can only be used by the holder, whether that is you or the person you designate at the time of purchase.

 

The gift card is therefore personal and non-transferable. It cannot be sold, exchanged or re-gifted by the holder under any circumstances. We may refuse any use of the gift card that is not made by the holder.

 

5.      How do you use the gift card?

 

Your gift card is redeemed by using the balance on the card. To use that balance, you must inform the hotel reception that you wish to use it as a means of payment at the time of payment for the services for which it is authorised. You must, in all cases, inform us of the product code and prove your identity as the holder with an official document.

 

You can use the balance of your gift card on one or more purchases, in whole or in part. You can also use the balance to partially pay for services, in which case you must supplement the remaining amount with any means of payment accepted by the hotel for the transaction to be effectively carried out.

 

Any use you make of your gift card will result in the amount spent on the purchase of the services being deducted from the balance of your gift card.

 

6.       Where can you use your gift card balance?

 

You can use your gift card at the reception of any hotel in Europe, Africa, Asia and the Orient operating under one of the Barceló Hotel Group brands, currently Barceló, Royal Hideaway, Occidental and Allegro.

7.      What can you use your gift card balance for?

 

The gift card can be used to pay for accommodation services at the hotel, as well as any complementary and directly related services.

 

8.      How long is your gift card valid?

 

The gift card and these terms and conditions are valid for 12 months from the moment the gift card is sent to the holder's email address. After this period, the gift card cannot be used and any balance on the card will automatically expire.

 

9.      Other characteristics of your gift card.

 

9.1   Where can you check the balance and validity of your gift card? You can access this information on our barcelo.com website or by calling our call centre.

 

9.2   In which currency can you purchase your gift card? You can purchase your gift card in euros, US dollars or pounds sterling. The balance on the gift card will be in the same currency as the purchase currency.

 

9.3   In which currencies can you use your gift card? You can only use your gift card for specific amounts in the same currency as that in which it was purchased. However, Barceló Hotel Group hotels will, at your request, convert the amount for which you may use your gift card into the currency of your gift card, duly informing you of the exchange rate and enabling you to use your gift card for the transaction.

 

9.4   Can you top up your gift card? Yes. The gift card can only be topped up by the holder. Any additional balance must be added in the same currency with which the gift card was originally purchased, and the balance will increase by the amount of the top up.

 

9.5   Is there a minimum and maximum balance for your gift card? Yes, the gift card balance may not be less than €0 or more than €2,000 at any time, or the equivalent of these amounts in the currency in which the gift card was issued, if different.

 

9.6   Can anything interrupt the usability of your gift card? Yes, errors, technical problems or maintenance work may cause some interruption to the usability of your gift card. In these cases, we will endeavour, where reasonably possible, to give you advance notice of any disruptions that will occur. However, we shall not be liable in the event of failure to give prior notice or in the event that the gift card cannot be used, provided that this is not for reasons directly and exclusively attributable to us.

 

9.7   What happens if your gift card is lost or stolen? You are solely responsible for the safekeeping and use of the gift card. However, we recommend that you contact us as soon as possible in the event of loss or theft.

 

9.8   Can you redeem the balance of the gift card as cash or request a refund? No, the gift card balance may be used solely and exclusively for the purchase of services in accordance with these terms and conditions and, therefore, may not be redeemed as cash or in the form of a refund of any kind.

 

10.   How will you receive or consult these conditions?

 

These terms and conditions will be sent to both you and the gift card holder, if different, to the email address indicated by you, in the form of a non-editable file that will enable you to keep them permanently in your records.

 

11.   Can these conditions change during the validity of your gift card?

 

These terms and conditions may only be amended by us for justified reasons. In that case, we will send you the new terms and conditions through the same channel as we sent the original terms and conditions.

 

12.   What happens to your personal data?

 

The personal data you provide or have provided to make the purchase will be processed by us, in our capacity as data controllers. 

 

Specifically, we will process your personal data for the following purposes: (i) to manage and formalise the contracting requested through the website; and (ii) to comply with obligations of an accounting, legal, fiscal and administrative nature (by application of pre-contractual measures). 

 

We may communicate personal data to: (i) other hotel companies in our network and, in particular, the hotel selected for the use of the gift card (this communication may involve an international transfer of data); (ii) competent public bodies, judges and courts; (iii) third-party service providers that have access to customers’ personal data and that process such data in our name and on our behalf as a result of their provision of services. 

 

The personal data to which access is granted will be processed for the time necessary for the fulfilment of the purpose for which they were collected. Following this time, we will store your personal data in a duly blocked manner, even when they are no longer pertinent for the purpose for which they were collected, in order to make them available to any competent public administration services, judges and courts, or the prosecution service during the statutory limitation period for any actions that may arise from the relationship maintained with the client and/or the legally stipulated retention periods. We will proceed to the physical deletion of your data once these periods have elapsed. 

 

In any case, you may exercise, if you wish, your rights of access, rectification and deletion of data, limitation of processing, opposition to processing, portability of your data, by sending a written communication to our Data Protection Delegate at the address c/ José Rover Motta, 27, 07006, in Palma de Mallorca or by sending an email to the address dpo@barcelo.com, attaching to this request, in both cases, a copy of your ID card, NIF or official document that identifies you.

13.   Can you cancel the purchase of your gift card?

 

Yes, for 14 calendar days after the purchase, or after we have sent the gift card to the holder, if later, you may cancel the purchase without giving any reason and we will reimburse the balance that exists at that time on the gift card, using the same means of payment as used for the purchase. To do this, you must inform us, within this period, of your unequivocal desire to cancel your gift card through the contact channels indicated in these terms and conditions, providing us with the code of your gift card.

In case of a credit voucher for booking cancellation, no refund applies, as this is issued subject to the prior contracting of a non-refundable rate.

15.   What is the applicable law?

 

We expressly agree that the law applicable to these terms and conditions and to the use of the gift card is Spanish common law.
