TERMS AND CONDITIONS

You are accepting these terms and conditions of the gift card that you are going to purchase. In the event that the purchase of the gift card is intended for use by a third person, it shall be understood by the first use of the gift card.

1. Who is who in these terms and conditions?

On the one hand, you. From now on, we can refer to you as well as the Title of the gift card. If you purchase a gift card so that you use it for another person, you will be deemed to be the Member of the gift card and, from the first use of this card, you include the terms and conditions, as if you were not.

On the other hand, we, Barceló Hotel Group. We are the issuers of the gift card and who sell this product. Legally, in these terms and conditions we are the company Barceló Gestión Hotelera, S.L.with NIF B-07918287, and our registered office is at Calle José Rover Motta, number 27, Palma de Mallorca.

2. What are these terms and conditions?

These terms and conditions are the contractual document between you and us. These rights and obligations will be collected as a result of the gift card.

3. What is the gift card?

The gift card you are purchasing is an instrument that allows your Member to have a balance that you can use to purchase certain services at different areas, as described in these terms and conditions. The amount of the balance that you have initially will be equivalent to the amount of the purchase of the gift card.

Despite the name, the gift card is not physical or physical card. When purchasing the gift card, the Member of the party will receive a code in the email that will constitute the product, that is, the gift card.

4. Who can use your gift card?

The gift card may only be used by the Member, which you or those designate when making the booking may be used.

Therefore, the gift card is personal and non-transferable, and in no event can it be sold, exchanged or awarded by the Member. Any use of the gift card that is not carried out by the Member may be denied.

5. How can you use your gift card?

Use of your gift card is made at the discretion of your balance. To do this, you must communicate that you want to use it as a means of payment at the hotel reception when you need to pay for the services for which it is enabled. You must, for any use, notify us of the product code and validate your identity as a Member through an official document.

You may use the balance of your gift card in one or more acquisitions, either totally or partially. The balance may also be used to partially pay for some services, in which case it should supplement any method of payment accepted by the hotel the amount remaining in order for the disposition to be made effectively.

Any use of your gift card will make the amount ready for purchasing the services to be purchased in your gift card.

6. Where can you use the balance of your gift card?

You can use your gift card at reception at any hotel in Europe, Africa, Asia and the East that operates under one of the Barceló Hotel Group’s brands, which are currently Barceló, Royal Hideaway, Occidental and Allegro.

7. Why can you use the balance on your gift card?

The gift card can be used to pay for the hotel's accommodation service, as well as any complementary services that relate to it.

8. What is the length of your gift card?

The gift card and these terms and conditions have a validity of 12 months from the moment the gift card is sent to the owner’s email. The gift card cannot be used, and any balance that is in it will be automatically consumed.

9. Other characteristics of your gift card

9.1 Where can you check the balance and validity of your gift card? You can access this information from our website, barcelo.com or by calling our call center.

9.2 In which currency can you purchase your gift card? You can purchase your gift card in Euros, American dollars or pound sterling. The balance that you have on the gift card will be called the same currency as the acquisition.

9.3 In which currency can you use your gift card? You may only use your gift card for certain amounts in the same currency as you purchased it. However, Barceló Hotel Group hotels will make a request for any amount in which you may use your gift card to the currency in which it is so called, and the Barceló Hotel Group hotels will be properly informed of the exchange type applied and thus permitting it to be used.

9.4 Can you recharge your gift card? Yes. The gift card may be recharged exclusively by the Member. Any recharge must be made in the same currency as the purchase of the gift card and there will be an increase in balance for an identical amount to that of the recharging.

9.5 Is there a minimum and maximum balance of your gift card? Yes, the balance of the gift card cannot be at any time less than 0 or more than €2,000, or the equivalent of these amounts in the currency that the gift card is called, in case of being different.

9.6 Can there any interruptions to the possibility of using your gift card? Yes, due to errors, technical problems or maintenance work, there may be any interruptions in the possibility of using your gift card. In such cases, we will try, as long as this is reasonably possible, to communicate the interruptions that happen in advance. However, we will not be responsible for any loss of prior communication or for the impossibility of use of the gift card, as long as this is not due to a direct cause and exclusively to our desire.

9.7 What if you lose or strollish your gift card? You are the sole entity responsible for safeguarding and use of the gift card. However, we recommend that you contact us as soon as possible, so we can contact you as soon as possible.

9.8 Can you request the balance of the gift card in cash or request your refund? No. The balance of the gift card can be reserved and exclusively for the purchase of services according to these terms and conditions and therefore, the balance cannot be made in cash nor reimbursed for any type.

10. How will you receive or consult these terms and conditions?

These terms and conditions shall be referred to you as well as to the Member of the gift card, if this is different, to the email address that has indicated us, through a non-editable file that allows them to keep them in a lasting manner.

11. Can you change these terms and conditions during the validity of the gift card?

These terms and conditions may only be modified by us due to cause. In this case, we hereby send you the new terms and conditions by the same channel that we send you original conditions.

 12. What about your personal data?

The personal data provided by you or provided to make the purchase will be treated by us, in the quality of the treatment manager.

In particular, we will process your personal data for the following purposes of treatment: (i) manage and formalize the requested booking through the website; and (ii) fulfill the accounting, legal, tax and administrative obligations (by the application of pre-contract measures).

We may transfer the personal data to: (i) other hotel companies that own the hotel and, in particular, the hotel selected to use the gift card (this communication may involve an international transfer of data), (ii) Competent Public Bodies, Judges and Courts, (iii) third party service providers that have access to the personal data of the clients, which they process as a result of providing them with services.

Any personal data to which BGH has access will be used for the necessary amount of time to achieve the purpose for which they were collected. In the event of this, we shall retain personal data when it is necessary to not be necessary for the purposes collected, duly blocked, for the provision of the relevant Public Administrations, Judges and Courts or the Tax Ministry during the term of prescribing the actions that may arise from the relationship maintained with the customer and/or the timings for legally authorized conservation. We will proceed with the physical deletion of your data once these deadlines have passed.

In any event, you may exercise, if you wish, the rights of access, rectification and deletion of data, limitation of processing, opposition to the processing, portability of your data, by sending a written communication to the Data Protection Officer in writing to c/ José Rover Motta, 27, 07006, in Palma de Mallorca or by sending an email to the address dpo@barcelo.com, , attached to this request, copies of the National ID document, ID or official document that identifies you.

13. Can you resist the purchase of the gift card?

Yes. For the 14 natural days after making the purchase, or to which we have sent the gift card to your owner, if this is later, you can reject the purchase without the necessary confirmation and we will refund the balance that exists on that moment in the Gift Card, using the same payment method used for you to purchase it. To do so, please notify us, within that time frame, your unequivocal desire to reject your gift card by the channels that we are sending in these terms and conditions to get in touch with us, indicating the code of your gift card.

15. What is applicable law?

We are expressly established that the law applicable to these terms and conditions and the use of the gift card is the Spanish common.
